1. Who we are
TokTuawThai ("we", "us", "our") is a social and lifestyle network centred on travel in Thailand, operated by , a Wyoming (USA) limited liability company, at toktuawthai.com and through our mobile apps (the "Service").
This Policy explains what personal data we collect, why, how we use and protect it, who we share it with, and the rights you have. It applies to all users and forms part of our Terms of Use.
The Service is for users aged 18 and over. We do not knowingly collect data from anyone under 18.
For privacy questions, contact us.
2. What data we collect
You give us:
- Account data β depending on how you sign up: email, phone number, password, date of birth (to confirm you are 18+), and the language you use.
- Sign-in data from third-party providers β if you register or log in with LINE, Google, Apple, WeChat, or Facebook, we receive a basic profile identifier and limited profile information from that provider (for example a name, email, or account ID), according to that provider's settings and your permissions. We use it to create and secure your account.
- Profile data β display name, gender, photos and videos, biographical details, interests, and anything else you add to your profile.
- Content β messages, chats, posts, reviews, photos, videos, and other material you create, send, or upload.
- Booking data β when you book travel, accommodation, tours, activities, or transport through the Service: the details needed to make the booking, such as your name, contact details, travel dates, number of guests, and any preferences or information the partner requires.
- Payment confirmation β travel bookings are generally paid directly to the travel partner, and other paid features are processed by the relevant app store or payment provider; we receive confirmation and limited transaction details, but we do not store your full card number.
- Support data β information you provide when you contact us.
We collect automatically:
- Location data β with your permission, your device's GPS / precise location to power location-based features (nearby people, places, and travel offers). You can turn location access off in your device settings; some features may then not work. We may also infer approximate location from your IP address.
- Device and usage data β device type, operating system, app version, language, identifiers, log data, and how you interact with the Service.
- Cookies and similar technologies β on our website, to keep you signed in, remember preferences, and understand usage. You can control cookies through your browser settings.
3. Why we use your data
We use your data to:
- create and manage your account, including via third-party sign-in, and verify that you are 18 or over;
- provide the Service β show profiles and a feed, enable messaging, photos, and videos, and power discovery and travel features;
- provide location-based features where you have enabled location access;
- arrange travel bookings you request and pass the necessary details to the relevant partner (see Section 4);
- process purchases and manage subscriptions;
- keep the Service safe β detect and prevent fraud, abuse, spam, and violations of our Terms, including child-safety enforcement (see the CSAE/CSAM Standards in the Terms of Use);
- respond to your support requests;
- send you service-related messages and, where permitted, notifications you have opted into;
- comply with legal obligations and enforce our Terms.
We rely on the appropriate legal bases for this processing (such as performing our contract with you, your consent, our legitimate interests in operating and securing the Service, and compliance with law). Where the law requires your consent β for example for precise location or certain notifications β we ask for it, and you can withdraw it at any time.
4. How your data is shared
We do not sell your personal data, and we do not share it with third parties for their own independent purposes. We share data only as described here:
- With travel and booking partners β to fulfil a booking you request. When you book accommodation, a tour, an activity, or transport, we share the information the partner needs to provide that service (such as your name, contact details, travel dates, and booking preferences). The partner processes that data under its own privacy policy as the party providing the service. We only share what is necessary for the booking you have chosen to make. If you do not make a booking, no booking data is shared.
- With other users, to the extent you choose β your public profile, photos, and any Content you post or send are visible to the people you share them with or, where applicable, to the public. Do not post anything you want to keep private.
- With sign-in providers β if you use LINE, Google, Apple, WeChat, or Facebook to log in, data is exchanged with that provider as needed to authenticate you. Their processing is governed by their own privacy policies.
- With service providers who work for us β for example hosting and infrastructure providers who process data on our behalf and under our instructions, solely to run the Service. They may not use your data for their own purposes.
- Where required by law β to comply with a legal obligation, court order, or lawful request, or to protect the rights, safety, and security of our users, the public, or the Company. This includes reporting confirmed child-sexual-abuse material to the relevant authorities.
- In a business transfer β if the Company is involved in a merger, acquisition, or sale of assets, data may be transferred as part of that transaction; we will notify you of any material change.
5. International transfers
We operate internationally, and your data may be stored and processed in countries other than where you live, including the United States and Thailand. Travel partners and sign-in providers you use may also be located in other countries. Where data is transferred across borders, we take steps to protect it consistent with this Policy and applicable law.
6. How long we keep data
We keep your personal data for as long as your account is active and as needed to provide the Service. After you delete your account, we delete or anonymise your data within a reasonable period, except where we must keep certain information to comply with legal obligations (including records of bookings), resolve disputes, prevent fraud or abuse, or enforce our Terms. Content you shared with other users, or that others copied, may remain visible after deletion.
7. Your rights and choices
Depending on where you live, you may have the right to:
- access the personal data we hold about you;
- correct inaccurate data (you can edit most profile data in the app);
- delete your data (you can delete your account in the app settings);
- object to or restrict certain processing;
- withdraw consent where we rely on it (e.g. turn off location access or notifications, or disconnect a third-party sign-in); and
- data portability, where applicable.
Thai users have rights under Thailand's Personal Data Protection Act (PDPA); users in other regions may have rights under their local laws. To exercise any right, contact us. We will respond as required by applicable law. You also have the right to complain to your local data-protection authority.
8. Security
We take reasonable technical and organisational measures to protect your data. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security. Keep your credentials confidential, and tell us immediately if you believe your account has been compromised.
9. Children
The Service is strictly for adults aged 18 and over. We do not knowingly collect personal data from anyone under 18. If we learn we have collected data from a minor, we will delete it. If you believe a minor is using the Service, report it through the in-app tools or at our contact form.
10. Changes to this Policy
We may update this Policy from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, notify you. If there is any inconsistency between the English version and a translation, the English version prevails.
