Terms of Use

The short version
Welcome to TokTuawThai. Please read these Terms in full β they apply every time you use our website and app. In short:
- TokTuawThai is a social network built around travel in Thailand β discovering places, planning trips, booking stays and experiences, and meeting and connecting with people along the way. It is for adults aged 18 and over only.
- Some travel, accommodation, and activity offers are provided by third-party partners. When you book, you are contracting with that partner, not with us β we help you find and arrange it.
- You are responsible for what you post and for how you treat other people. We may remove content or accounts that break these rules.
- We do not run background checks on users and we do not verify that people are who they say they are. Be careful, use common sense, and take precautions when meeting anyone in person.
- We have zero tolerance for any content or behaviour that sexually exploits or endangers children. See Section 14.
- How we handle your personal data β including data shared with booking partners and sign-in providers β is explained in our Privacy Policy, which forms part of these Terms.
If you do not accept these Terms, you must not access or use the Service.
1. Who we are and what this agreement covers
TokTuawThai ("TokTuawThai", "we", "us", or "our") is operated by , a limited liability company formed in the State of Wyoming, United States ("the Company"). When we refer to TokTuawThai we mean the website at toktuawthai.com, together with our affiliated websites, mobile applications, and features (collectively, the "Service").
These Terms of Use, together with our Privacy Policy and any community guidelines we publish (together, the "Terms"), form a binding legal agreement between you ("you" or "Member") and the Company. The Terms apply whenever you access or use the Service, whether or not you register an account.
By accessing, using, registering for, or receiving any part of the Service, you accept and agree to be bound by the Terms. If you do not accept and agree to the Terms, you must not access or use the Service.
2. What TokTuawThai is
TokTuawThai is a social and lifestyle network centred on travel and life in Thailand. Through the Service you can:
- discover places, destinations, and local recommendations;
- plan trips and browse and book accommodation, tours, activities, and transport offered by third-party partners;
- create a profile, share photos, videos, and posts, and follow a feed of people and places;
- meet, message, and connect with other members β locals, expats, and travellers β and build friendships and connections.
Meeting and connecting with people is one part of a broader travel and community experience. You decide how you use the Service and how you interact with others.
3. Travel bookings and third-party partners
We are an intermediary, not the travel provider. Some accommodation, tours, activities, and transport shown in the Service are provided by third-party suppliers and partners. Even where an offer appears within TokTuawThai and under our branding, the actual travel service is supplied by the relevant third-party partner, and your booking creates a contract between you and that partner, governed by that partner's own terms and conditions.
Accordingly:
- We do not provide the travel service ourselves and are not the operator, carrier, or accommodation provider. We help you discover, compare, and arrange bookings.
- Payment for bookings is generally made directly to the partner (or through the partner's payment process). Prices, availability, taxes, and fees are set by the partner and may change.
- Cancellations, changes, refunds, and complaints about a booking are handled according to the partner's terms and policies. Please read them before you book.
- We are not responsible for the acts, omissions, quality, safety, or performance of any third-party partner or the travel services they provide. Your dealings with partners are between you and them.
- Partner offers may not be available in all regions and may be subject to local law.

4. Eligibility
You may only use the Service, or register as a Member, if you are 18 years of age or older (or older, if the age of majority where you live is greater than 18).
By using the Service you represent and warrant that:
- you are at least 18 years old;
- you have the right, authority, and capacity to enter into and comply with the Terms;
- your use of the Service will not violate any law or regulation that applies to you;
- you have not been convicted of, and are not subject to any court order relating to, assault, violence, sexual misconduct, or harassment, and you are not required to register as a sex offender with any authority; and
- all registration information you provide is true, accurate, and kept up to date.
If we discover that you are under 18 or have misrepresented your age, your account may be removed without notice.
5. Your account and sign-in
You can create an account using your phone number, email, or a third-party sign-in service such as LINE, Google, Apple, WeChat, or Facebook. When you sign in with a third-party service, you authorise us to receive certain information from that service (such as a basic profile identifier), and their terms and privacy policies also apply to that sign-in. The Privacy Policy explains what we receive.
You are responsible for keeping your account credentials secure and for all activity under your account. Do not share your account or use anyone else's. If you believe your account is no longer secure, change your password (where applicable) and notify us. Your account is for your personal, non-commercial use only.
6. Content and conduct
You can post, upload, and send content on the Service, including photos, videos, messages, reviews, and other materials ("Content"). You are solely responsible for your Content and for your interactions with other people.
You may not post, send, or upload any Content, or behave in any way, that:
- is illegal, or encourages or facilitates illegal activity;
- harms or endangers minors in any way (see Section 14);
- is defamatory, harassing, threatening, abusive, hateful, discriminatory, or invasive of another person's privacy;
- is obscene, pornographic, sexually exploitative, or violent, or otherwise offends human dignity;
- shows another person without their consent, or shows a photo that is not of you as your own profile photo;
- infringes anyone's intellectual property or other rights;
- impersonates any person or misrepresents your identity, age, or affiliation;
- is commercial or promotional β advertising, spam, chain letters, solicitation, or collecting other users' data for such purposes β unless we have approved it;
- solicits money, banking, or financial information from other users (never send money to someone you meet through the Service); or
- contains viruses or other malicious code.
We use a combination of automated systems, user reports, and human moderators to review accounts and Content. We may, at our discretion and without notice, remove Content, and restrict, suspend, or terminate accounts that we believe breach the Terms or applicable law. We are not obligated to monitor Content, but we may do so.
7. Meeting and connecting with other people β use caution
The Service lets you meet and connect with other members. We do not conduct criminal background checks on users, and we do not routinely verify the identity, statements, age, or background of any user. We make no representations about the conduct, identity, or compatibility of any user, and we cannot guarantee that any user is who they claim to be.
You are solely responsible for your interactions with other users. Take sensible precautions β especially before sharing personal information or meeting anyone in person; meet in public, and tell someone where you are going. To the fullest extent permitted by law, you release the Company and its affiliates, and their officers, directors, employees, and agents, from any claims, damages, or losses of any kind arising from your interactions with, or the conduct of, other users, whether online or offline.
You can report and block other users at any time using the in-app tools. We encourage you to report anyone who breaches these Terms.
8. Licence to your Content
You keep ownership of the Content you create (provided you owned it in the first place). By posting Content on the Service, you grant the Company a non-exclusive, royalty-free, worldwide, transferable, sub-licensable licence to host, store, use, copy, adapt, translate, reformat, distribute, and display that Content for the purpose of operating, providing, and promoting the Service. This licence ends when you delete the Content or your account, except that (a) Content you shared with others, or that others copied, may persist, and (b) we may retain copies as required by law or as described in the Privacy Policy.
By posting Content you represent and warrant that you own it or have all necessary rights and consents, and that it does not violate the Terms or any law.
9. Our intellectual property
All text, graphics, user interfaces, trademarks, logos, software, and other materials on the Service (other than user Content and partner materials) are owned by or licensed to the Company and are protected by intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Service except as expressly permitted.
10. Paid services
Aside from third-party travel bookings (Section 3), the Service may offer paid features such as subscriptions, premium memberships, and virtual items or credits ("Paid Services"). Some features are free; premium features require payment.
Billing. You may purchase Paid Services through the Apple App Store, the Google Play Store, or any other payment method we make available. By purchasing, you authorise us (or the relevant store) to charge your payment method according to the pricing and billing terms shown at the time of purchase. Prices may vary by region and over time and may include applicable taxes.
Auto-renewing subscriptions. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. Manage and cancel subscriptions through the store you bought them from, or your account settings if purchased directly from us. Deleting the app or your account does not cancel a subscription. Cancelling stops future renewals; you keep access until the end of the paid period.
Free trials. If you sign up for a free trial and do not cancel before it ends, it may convert into a paid subscription at the then-current price.
Credits / virtual items. These have no monetary value, are not transferable or redeemable for cash, and may expire.
Refunds. Except where required by applicable law, charges for Paid Services are non-refundable and there are no refunds for partially used periods. Store purchases (Apple/Google) are refunded under their policies, not ours. Refunds for travel bookings are handled by the relevant travel partner under their policy.
11. Availability of the Service
The Service is provided on an "as is" and "as available" basis. We do not guarantee it will always be available, uninterrupted, error-free, or secure; we may carry out maintenance and may suspend, withdraw, or change any part of the Service without notice. You are responsible for the internet access and device needed to use the Service, and any related charges.
12. Termination
By you. You may stop using the Service and delete your account at any time in the app settings or by contacting support. Cancelling a paid subscription is separate (Section 10). Travel bookings already made are governed by the partner's terms.
By us. We may restrict, suspend, or terminate your access at any time, with or without notice, if we believe you have breached the Terms or applicable law, or to protect the Service or other users. Some Content (such as messages you sent) may remain visible to others after termination.
We may also deactivate accounts that have been inactive for an extended period, except where you hold an active paid subscription.
13. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that information on the Service (including partner offers, prices, and availability) is accurate, reliable, or complete, or that the Service will be uninterrupted or secure. Your use of the Service is at your own risk.
To the fullest extent permitted by law, the Company and its affiliates, and their officers, directors, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to (a) your use of or inability to use the Service, (b) the conduct of other users, or (c) any travel service or booking provided by a third-party partner β even if we have been advised of the possibility of such damages.
In no event will the Company's total liability to you for all claims arising out of or relating to the Service or the Terms exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the liability, or (b) [USD 100]. For the avoidance of doubt, amounts you paid to third-party travel partners are not amounts paid to us.
Nothing in the Terms excludes or limits any liability that cannot lawfully be excluded or limited.
14. Standards against child sexual abuse and exploitation (CSAE / CSAM)
The safety of children is a priority. We are committed to keeping the Service free of child sexual abuse and exploitation, and we apply these Standards to every user.
14.1 Definitions.
- CSAE means child sexual abuse and exploitation: any content or behaviour that sexually exploits, abuses, or endangers a child, including grooming, sextortion, trafficking of a child for sex, or otherwise sexually exploiting a child.
- CSAM means child sexual abuse material: any visual depiction β including photos, videos, and computer-generated imagery β involving a minor engaging in sexually explicit conduct.
14.2 Zero tolerance. We have a zero-tolerance policy for CSAE and CSAM. Such content and conduct are illegal and strictly prohibited. Any such Content will be removed and appropriate legal action taken, including reporting to law enforcement.
14.3 Prohibited activities. Strictly prohibited: any form of CSAE; uploading, storing, producing, sharing, or promoting CSAM; sharing third-party links to CSAM; engaging in or facilitating conversations about sexually explicit conduct involving a child; and any activity aimed at grooming a minor. These are prohibited even if the stated intent is to express outrage or raise awareness.
14.4 Reporting. Report any violating content or behaviour using the in-app reporting tools, or contact our designated point of contact at our contact form.
14.5 Enforcement. We review and investigate all reports promptly. Violations result in content removal, account suspension or termination, and referral to the relevant authorities.
14.6 Cooperation with law enforcement. In line with applicable law, we report confirmed CSAM to the relevant authority (such as the U.S. National Center for Missing & Exploited Children (NCMEC) and/or the appropriate authority in Thailand) and cooperate with investigations.
14.7 Updates. We may update these Standards at any time to reflect current laws, regulations, and best practices.
15. Third-party links and services
The Service may contain links to, and integrations with, third-party websites, partners, and services (including travel partners and sign-in providers). These are governed by their own terms and privacy policies. We have no control over and accept no responsibility for third-party services or their content, terms, or practices. Review their terms before using them.
16. Privacy
We process your personal data in accordance with our Privacy Policy, which is incorporated into and forms part of these Terms. Please read it before using the Service. By using the Service, you agree to that processing and confirm that the data you provide is accurate.
17. Changes to the Terms
We may modify the Terms at any time. If we do, we will post the updated Terms and update the "Last updated" date, and where appropriate notify you. If you do not accept a change, you must stop using the Service. Continued use after a change takes effect means you accept the updated Terms.
18. Governing law and disputes
The Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Wyoming will have jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise. Disputes about a travel booking may also be subject to the partner's terms and the law that applies to them.
If there is any inconsistency between the English version of the Terms and a translation, the English version prevails.
19. General
- Severability. If any provision is unenforceable, the rest remains in force.
- No waiver. Our failure to enforce a right is not a waiver of it.
- Assignment. You may not assign your rights under the Terms. We may assign ours, e.g. in a merger, acquisition, or sale of assets.
- Entire agreement. The Terms (with the Privacy Policy and any community guidelines) are the entire agreement between you and the Company regarding the Service and supersede prior agreements.
- Relationship. Nothing in the Terms creates a partnership, joint venture, employment, or agency relationship between you and the Company.
